CureKit — Terms and Conditions of Use

⚠️ IMPORTANT MEDICAL NOTICE CureKit is a home medication organization tool. It is not a medical device and does not provide clinical advice, diagnoses, prescriptions, or dosage recommendations. If in doubt about medication or health matters, always consult a qualified healthcare professional.
1. Acceptance of Terms
By creating an account or using the CureKit app, the user fully accepts these Terms and Conditions, as well as the CureKit Privacy Policy. If you do not agree, you should refrain from using the app.
2. Definitions
- CureKit / Service: The CureKit mobile app and all associated services.
- User: Any person registered on the platform.
- Owner: A user holding a paid subscription, who creates and administers Kits.
- Member: A user invited by an Owner to access a Kit, without needing their own subscription.
- Kit: A virtual medication inventory created and managed by an Owner.
- Subscription: A paid contract for access to CureKit's premium features.
3. Description of the Service
CureKit allows you to:
- Register and manage medications (name, expiry date, quantity, photo, notes)
- Share the inventory with family members or people under your care
- Receive expiry alerts
- Manage multiple Kits (according to your subscribed plan)
- Access medication history and archive
CureKit does not replace any healthcare professional, pharmacist, clinical management system, or medication package insert.
4. Eligibility
- The user must be at least 18 years old
- Users under 18 may only use the service under the supervision and responsibility of an adult account holder
- The user must provide truthful information during registration
5. Subscription and Payment Model
5.1 Available plans

5.2 Trial period
- All plans include a 7-day free trial
- The user is not charged during the trial
- After the trial, the subscription renews automatically unless cancelled beforehand
5.3 Payment and billing
- Payments are processed by Apple App Store (StoreKit 2) or Google Play Store (Play Billing), depending on the device
- CureKit does not store payment or credit card data
- Invoices are issued directly by Apple or Google
- Prices may vary by region according to store policies
5.4 Renewal and cancellation
- The subscription renews automatically at the end of each period
- Cancellation must be done through App Store or Google Play settings, at least 24 hours before renewal
- After cancellation, access remains active until the end of the paid period
- No refunds are issued for partially used periods, except where legally required
5.5 Plan downgrade
- When downgrading to a plan with fewer Kits, the user must select which Kits remain active
- Excess Kits are archived (data preserved) and can be reactivated upon upgrading
- The Owner remains responsible for archived data
5.6 Account cancellation
- After subscription cancellation, data remains accessible in read-only mode for 30 days
- After this period, data is permanently deleted, unless export was requested beforehand
6. Owner / Member Model
6.1 Owner
- The Owner is the subscription holder and administrator of their Kit(s)
- The Owner can invite members and assign permissions (read-only or read+write)
- The Owner can remove members at any time
- The Owner is responsible for use of the Kit by the members they invited
6.2 Invited Member
- Invited members access the Kit free of charge, without needing their own subscription
- A user can be a member of multiple Kits simultaneously
- A member cannot create their own Kits without a subscription
- A member can leave a Kit at any time
6.3 Kit Switcher
- Users with access to multiple Kits can switch between them in the app
- Each Kit is isolated: medications, alerts, and history are independent
7. Permitted Use
The user agrees to use CureKit exclusively for legitimate personal or family medication organization purposes, and to:
- Provide truthful information about registered medications
- Not use the app for commercial or regulated clinical purposes
- Not share access credentials with unauthorized third parties
- Respect the privacy of their Kit members
8. Prohibited Use
It is expressly prohibited to:
- Use CureKit as a clinical management system in a hospital, pharmacy, or similar context
- Attempt to access other users' data without authorization
- Reverse engineer, decompile, or modify the app
- Use the app for illegal purposes or purposes that violate third-party rights
- Register medications with intent to commit unlawful acts
9. Use in Professional / Caregiver Context
The Caregiver and Professional plans are intended for medication management in a home or semi-informal context (e.g., a family caregiver of elderly relatives at home, home care assistant).
CureKit is not certified as medical software for use in:
- Hospitals, clinics, or regulated healthcare units
- Pharmacies
- Care homes with a legal requirement for software certified by national health authorities or regulatory bodies
Users operating in these contexts are solely responsible for ensuring compliance with applicable regulations.
10. Intellectual Property
- All intellectual property of CureKit (code, design, brand, logo) belongs to the service owner
- The user acquires no rights over CureKit's intellectual property
- The user retains ownership of the data they enter into the app
11. Limitation of Liability
CureKit is not responsible for:
- Health decisions made based on information recorded in the app
- Recording errors made by the user (incorrect expiry dates, wrong quantities, etc.)
- Consequences of expired medications not detected in time
- Data loss due to device failure or app uninstallation
- Temporary service unavailability due to maintenance or technical failure
CureKit's maximum liability is limited to the amount paid by the user in the last month of subscription.
12. Service Availability
- CureKit strives to maintain 99.5% monthly availability
- Scheduled maintenance will be communicated in advance
- CureKit reserves the right to change, suspend, or discontinue features with reasonable prior notice
13. Account Termination
CureKit may suspend or delete a user's account in case of:
- Violation of these Terms
- Fraudulent or abusive use of the service
- Non-payment of the subscription
In case of deletion due to non-compliance, data may be deleted without the right to prior export.
14. Changes to the Terms
CureKit may update these Terms periodically. Changes will be communicated by email and/or in-app notification. Continued use after the effective date of the changes constitutes acceptance of the new terms.
15. Governing Law and Dispute Resolution
- These Terms are governed by Portuguese law
- In case of dispute, the user may resort to the Consumer Dispute Arbitration Center (CACCL) or the European online dispute resolution portal: https://ec.europa.eu/consumers/odr
- In the absence of out-of-court resolution, the competent court is that of the Lisbon judicial district
